These Terms of Service govern your use of ibaoralcareshop.com and purchases made directly through our online store.

By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy, and Refund & Return Policy.

Nothing in these Terms is intended to limit any mandatory rights available to consumers under applicable United Arab Emirates law.

1. ABOUT IBA ORAL CARE

IBA Oral Care operates this online store and provides oral-care products to customers within the United Arab Emirates.

  • Submit false, fraudulent, or misleading information.

Where customer accounts are available, you are responsible for keeping your login information secure and for providing accurate account information.

You must have the legal capacity required under applicable law to enter into a purchase transaction.

3. PRODUCT INFORMATION

We aim to provide accurate descriptions, images, specifications, prices, and other relevant information about our products.

Product colours or appearance may vary slightly depending on your screen, device settings, lighting, or photography.

We will not knowingly provide misleading information about a product or materially misrepresent its characteristics.

Product availability may change without notice.

Nothing in this section limits your rights where a product is defective, damaged, incorrectly supplied, or materially different from its description.

4. ORAL-CARE AND EDUCATIONAL CONTENT

Information published by IBA Oral Care about oral hygiene, dental care, or product use is intended for general educational and product-information purposes.

It is not a substitute for diagnosis, treatment, or individual advice from a qualified dentist or healthcare professional.

Customers should follow the instructions and safety information supplied with each product and seek professional advice where appropriate.

5. ORDERS

When you submit an order, you are requesting to purchase the selected products at the price and on the terms shown at checkout.

We may decline or cancel an order where reasonably necessary, including where:

  • Payment cannot be authorised.

  • A product is unavailable.

  • There is a genuine pricing or listing error.

  • We reasonably suspect fraud or misuse.

  • Delivery to the specified location is unavailable.

  • The transaction cannot legally be completed.

If we cancel an order after payment has been collected and no product has been supplied, the applicable amount paid for that cancelled order will be refunded.

We may contact you using the contact information provided with your order where clarification is required.

6. PRICES AND PAYMENT

Product prices and applicable delivery charges will be displayed before you complete your purchase.

Any applicable taxes or charges required to be included or disclosed under UAE law will be handled accordingly.

The available payment methods will be shown during checkout.

Payments may be processed by Shopify and/or authorised third-party payment providers.

You are responsible for providing accurate billing information and for using a payment method that you are authorised to use.

We will not add undisclosed charges to a completed order.

7. SHIPPING AND DELIVERY

IBA Oral Care currently delivers within the United Arab Emirates only.

Our current standard delivery method is Express Shipping, normally estimated at 1–2 business days after dispatch, subject to the conditions described in our Shipping Policy.

Order-processing time is separate from delivery time.

Shipping charges, delivery estimates, failed deliveries, delays, lost shipments, damaged shipments, and related matters are governed by our Shipping Policy.

Nothing in these Terms transfers to the customer responsibility for loss, damage, or another delivery issue where responsibility remains with IBA Oral Care under applicable UAE law.

8. RETURNS, REFUNDS, AND PRODUCT ISSUES

Returns and refunds are governed by our Refund & Return Policy.

For eligible non-defective products, IBA Oral Care currently provides a 7-calendar-day change-of-mind return period beginning on the date the customer receives the order, subject to the conditions stated in that policy.

Different rules apply to products that are defective, damaged, incomplete, incorrectly supplied, or otherwise not in conformity with the order or applicable requirements.

The 7-day change-of-mind period does not limit mandatory legal rights relating to defective or non-conforming products.

9. ORDER CHANGES AND CANCELLATIONS

If you wish to change or cancel an order, please contact us as soon as possible at:

We will make reasonable efforts to accommodate the request before the order is processed or dispatched.

Once an order has been processed, packed, or dispatched, cancellation or modification may no longer be possible.

Orders that have already been dispatched will be handled in accordance with our Shipping Policy and Refund & Return Policy, without limiting any mandatory rights under UAE law.

10. INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its original content, including the IBA Oral Care name, branding, logos, graphics, photographs, videos, written content, product presentation, and website design, are owned by or licensed to IBA Oral Care and are protected by applicable intellectual property laws.

You may use the website for normal personal and non-commercial purposes.

You may not reproduce, distribute, sell, commercially exploit, or falsely represent our protected content as your own without permission, except where permitted by applicable law.

Third-party trademarks and content remain the property of their respective owners.

11. THIRD-PARTY SERVICES

Our website may use or link to third-party services, including Shopify, payment providers, delivery companies, social-media platforms, or other service providers.

Those third parties may operate under their own terms and privacy policies.

IBA Oral Care remains responsible for its own obligations to customers and does not use the involvement of a third-party service provider to exclude responsibilities that cannot legally be excluded.

12. PRIVACY

Personal information collected through our website is handled in accordance with our Privacy Policy and applicable UAE data-protection requirements.

13. LIABILITY

IBA Oral Care is responsible for its obligations to customers to the extent required by applicable UAE law.

To the extent permitted by law, IBA Oral Care will not be responsible for losses resulting solely from circumstances outside our reasonable control or from a customer's misuse of a product contrary to its instructions.

Nothing in these Terms excludes or restricts:

  • Mandatory consumer rights.

  • Rights relating to defective or unsafe products.

  • A customer's right to claim compensation where provided by law.

  • Any liability that cannot legally be excluded or limited.

14. ERRORS AND CORRECTIONS

Occasionally, the website may contain genuine typographical, technical, pricing, availability, or other errors.

We may correct such errors when identified.

If an error materially affects an order that has already been placed, we will inform the customer as appropriate.

If the order cannot reasonably be fulfilled on the terms confirmed to the customer and is cancelled, amounts collected for the affected products will be refunded.

This section does not allow IBA Oral Care to retrospectively impose a higher price or materially different terms on an accepted order without the customer's agreement where such action would not be permitted by law.

15. CHANGES TO THESE TERMS

We may update these Terms where reasonably necessary, including because of changes to our services, business operations, or legal requirements.

The latest version will be published on this page with an updated revision date.

Changes will generally apply prospectively and will not remove rights already acquired in relation to completed or accepted orders, unless otherwise required by applicable law.

16. GOVERNING LAW

These Terms and purchases made directly from IBA Oral Care are governed by the applicable laws of the United Arab Emirates.

Any dispute will be subject to the jurisdiction of the competent courts and authorities in the UAE, without limiting any consumer rights or complaint mechanisms available under applicable law.

4. محتوى العناية بالفم والمحتوى التثقيفي

المعلومات التي تنشرها IBA Oral Care حول نظافة الفم أو العناية بالأسنان أو استخدام المنتجات مخصصة لأغراض تثقيفية عامة ولتقديم معلومات عن المنتجات.

ولا تعتبر هذه المعلومات بديلًا عن التشخيص أو العلاج أو المشورة الفردية المقدمة من طبيب أسنان أو مختص رعاية صحية مؤهل.

يجب على العملاء اتباع تعليمات الاستخدام والسلامة المرفقة مع كل منتج وطلب المشورة المهنية عند الحاجة.

5. الطلبات

عند تقديم طلب، فإنكم تطلبون شراء المنتجات المحددة بالسعر والشروط المعروضة أثناء إتمام عملية الشراء.

يجوز لنا رفض الطلب أو إلغاؤه عند وجود سبب معقول، بما في ذلك الحالات التالية:

  • تعذر اعتماد عملية الدفع.

  • عدم توفر المنتج.

  • وجود خطأ فعلي في السعر أو بيانات المنتج.

  • وجود اشتباه معقول في احتيال أو إساءة استخدام.

  • عدم إمكانية التوصيل إلى الموقع المحدد.

  • عدم إمكانية إتمام المعاملة بصورة قانونية.

إذا قمنا بإلغاء طلب بعد تحصيل المبلغ ولم يتم توفير المنتج، فسيتم رد المبلغ المستحق الخاص بالطلب الملغى.

قد نتواصل معكم باستخدام بيانات الاتصال المقدمة مع الطلب إذا احتجنا إلى توضيح أي معلومات.

6. الأسعار والدفع

سيتم عرض أسعار المنتجات ورسوم التوصيل المطبقة قبل إتمام عملية الشراء.

وسيتم التعامل مع أي ضرائب أو رسوم يجب تضمينها أو الإفصاح عنها وفقًا للقوانين الإماراتية المعمول بها.

ستظهر طرق الدفع المتاحة أثناء إتمام الطلب.

قد تتم معالجة المدفوعات عن طريق Shopify و/أو مزودي خدمات دفع معتمدين من أطراف ثالثة.

يتحمل العميل مسؤولية تقديم معلومات فوترة صحيحة واستخدام وسيلة دفع مخول باستخدامها.

لن نقوم بإضافة رسوم غير معلنة إلى طلب تم إتمامه.

7. الشحن والتوصيل

تقوم IBA Oral Care حاليًا بالتوصيل داخل دولة الإمارات العربية المتحدة فقط.

طريقة التوصيل القياسية لدينا حاليًا هي الشحن السريع Express Shipping، ويستغرق عادةً ما يقدر بـ 1–2 يوم عمل بعد شحن الطلب، وفقًا للشروط الموضحة في سياسة الشحن.

مدة تجهيز الطلب منفصلة عن مدة التوصيل.

تخضع رسوم الشحن ومدة التوصيل المقدرة ومحاولات التسليم غير الناجحة والتأخير والشحنات المفقودة أو التالفة والمسائل ذات الصلة لسياسة الشحن الخاصة بنا.

لا تنقل هذه الشروط إلى العميل المسؤولية عن فقدان الشحنة أو تلفها أو أي مشكلة في التوصيل إذا كانت المسؤولية تقع على IBA Oral Care بموجب القانون الإماراتي المعمول به.

8. الإرجاع والاسترداد ومشكلات المنتجات

تخضع عمليات الإرجاع والاسترداد لسياسة الإرجاع والاسترداد الخاصة بنا.

بالنسبة للمنتجات السليمة المؤهلة للإرجاع، توفر IBA Oral Care حاليًا مدة 7 أيام تقويمية للإرجاع بسبب تغيير رأي العميل، تبدأ من تاريخ استلام الطلب، وفقًا للشروط الموضحة في سياسة الإرجاع والاسترداد.

تطبق قواعد مختلفة على المنتجات التي تكون معيبة أو تالفة أو ناقصة أو تم إرسالها بصورة خاطئة أو لا تتوافق مع الطلب أو المتطلبات القانونية المطبقة.

لا تحد مدة السبعة أيام الخاصة بتغيير الرأي من أي حقوق قانونية إلزامية تتعلق بالمنتجات المعيبة أو غير المطابقة.

9. تعديل الطلبات وإلغاؤها

إذا كنتم ترغبون في تعديل أو إلغاء طلب، يرجى التواصل معنا في أقرب وقت ممكن عبر:

سنبذل جهودًا معقولة لتنفيذ الطلب قبل تجهيز الطلب أو شحنه.

بعد تجهيز الطلب أو تغليفه أو تسليمه لشركة الشحن، قد لا يكون الإلغاء أو التعديل ممكنًا.

الطلبات التي تم شحنها بالفعل ستتم معالجتها وفقًا لسياسة الشحن وسياسة الإرجاع والاسترداد، دون المساس بأي حقوق إلزامية للعميل بموجب القانون الإماراتي.

10. الملكية الفكرية

ما لم يُذكر خلاف ذلك، فإن الموقع والمحتوى الأصلي الموجود عليه، بما في ذلك اسم IBA Oral Care والعلامة التجارية والشعارات والرسومات والصور ومقاطع الفيديو والمحتوى المكتوب وعرض المنتجات وتصميم الموقع، مملوك لـIBA Oral Care أو مرخص لها باستخدامه ومحمي بموجب قوانين الملكية الفكرية المعمول بها.

يجوز استخدام الموقع لأغراض شخصية وغير تجارية بصورة عادية.

ولا يجوز نسخ أو توزيع أو بيع أو استغلال المحتوى المحمي تجاريًا أو الادعاء بأنه مملوك لكم دون إذن، إلا بالقدر الذي يسمح به القانون.

13. المسؤولية

تتحمل IBA Oral Care مسؤولياتها تجاه العملاء بالقدر المطلوب بموجب القوانين الإماراتية المعمول بها.

وبالقدر الذي يسمح به القانون، لا تتحمل IBA Oral Care المسؤولية عن الخسائر الناتجة حصريًا عن ظروف خارجة عن نطاق سيطرتها المعقولة أو عن استخدام العميل للمنتج بصورة مخالفة لتعليمات الاستخدام.

لا يستبعد أو يحد أي شيء في هذه الشروط من:

  • حقوق المستهلك الإلزامية.

  • الحقوق المتعلقة بالمنتجات المعيبة أو غير الآمنة.

  • حق العميل في المطالبة بالتعويض متى كان ذلك مقررًا بموجب القانون.

  • أي مسؤولية لا يجوز قانونًا استبعادها أو الحد منها.

14. الأخطاء والتصحيحات

قد يحتوي الموقع أحيانًا على أخطاء فعلية مطبعية أو تقنية أو أخطاء في الأسعار أو التوفر أو معلومات أخرى.

يجوز لنا تصحيح هذه الأخطاء عند اكتشافها.

إذا أثر الخطأ بصورة جوهرية على طلب تم تقديمه بالفعل، فسنقوم بإبلاغ العميل حسبما تقتضيه الحالة.

إذا تعذر تنفيذ الطلب بصورة معقولة وفقًا للشروط التي تم تأكيدها للعميل وتم إلغاء الطلب، فسيتم رد المبالغ التي تم تحصيلها عن المنتجات المتأثرة.

لا يسمح هذا القسم لـIBA Oral Care بفرض سعر أعلى بأثر رجعي أو شروط مختلفة بشكل جوهري على طلب تم قبوله دون موافقة العميل إذا كان القانون لا يسمح بذلك.

15. التعديلات على هذه الشروط

يجوز لنا تحديث هذه الشروط عند وجود حاجة معقولة لذلك، بما في ذلك نتيجة تغييرات في خدماتنا أو عملياتنا التجارية أو المتطلبات القانونية.

سيتم نشر أحدث نسخة من الشروط على هذه الصفحة مع تحديث تاريخ المراجعة.
